Dr. Toshio NAKAMURA attended “C5’s 15th International Forum on Pharmaceutical Patent Term Extension”

Dr. Toshio Nakamura in Sakamoto & Partners made a presentation at “C5’s 15th International Forum on Pharmaceutical Patent Term Extension” held in Munich, Germany on June 21st and 22nd: http://www.c5-online.com/PPE. The presentation was well received by its audiences by the participants. His presentation concerned “Review of the Changing Practices in Japan”, containing three big topics in Japan:

(1) the changing practices in light of the decision of the Supreme Court judgement, Kyowa Hakko Kirin vs Teva (June 5, 2015), concerning the interpretation of “Product by Process claims”,
(2) the latest Japan Supreme Court judgment, JPO vs Genentech (November 17, 2015), concerning patent term extensions, and
(3) the IP High Court Grand Panel judgment DKSH Japan et al vs Chugai Pharmaceutical (March 25, 2016), concerning “Doctrine of Equivalent” of Vitamin D preparation method.
